Manchester-by-the-Sea, a North Shore town of about 5,600, adopted a Nicotine-Free Generation regulation on October 24, 2024 by 3 to 1. It took effect November 1, 2024, with the sales prohibition enforceable from April 1, 2025.

This is the one town here where residents voted on the regulation after it was already in force — and voted against it. At Town Meeting on April 28, 2025 the motion to overturn carried 81 to 76, with four abstentions. That vote was non-binding, so the Board of Health was not required to act on it and did not. The regulation remains in effect.

What the records show

Residents voted to overturn the regulation and it stayed in force. At Town Meeting on April 28, 2025 the vote was 81 to 76, with four abstentions; non-binding, and the Board of Health did not act.
The health director read the loss as a mandate. The next day: “It was so close that the BOH is justified saying that you side with the ½ that want to protect youth.”
When local retailers objected, the regional program brought in an outside advocate. Its director answered their letter on October 23, 2024, the day before the hearing, copying the Brookline pharmacist who promoted the policy there.
The template came from the state-funded regional program, already directing the town’s tobacco regulation rewrite. Northeastern’s Public Health Advocacy Institute submitted unrequested written testimony.
The proposal did originate locally, unusual here. The minutes record board member Leah Peavey saying “that she herself had brought the proposal to the Board,” citing a tobacco-related family death and her medical work.
