Ashland has not adopted a Nicotine-Free Generation regulation. On November 18, 2025 its Board of Health decided the choice was not the Board's to make, agreed the policy was outside its purview, and asked that its position be relayed to the Town Manager.
It did not end there. On January 7, 2026 the Board met jointly with the Select Board, which took the matter under advisement and indicated it should be settled at Town Meeting. The proposal remains live.
Ashland's 18 documents show the proposal brought to the town from outside — by physicians, a law professor and a board member from another town, using model language from a university law center.
What the records show
Nobody in Ashland asked for this. Dr. Zachary Rich, from outside town, asked Health Director Rajit Gupta for a slot before the Board to advocate adoption.
The testifiers were not from Ashland either — a Boston University law professor and a sitting Belchertown Board of Health member — nor the proposed text, from a Northeastern University law center, not town counsel.
The Board refused: not theirs to decide. On November 18, 2025 the minutes record the Chair asking that the Health Director report to the Town Manager and Select Board “that we, as a Board, feel this is not our decision to make.”
It was referred onward, not dropped. On January 7, 2026 the Board met with the Select Board, which took it under advisement and pointed to Town Meeting by warrant article.
